Ujamaapay Limited is a Kenyan company established in 2023. We operate a collective commerce and group buying marketplace that connects:

  • Buyers pooling funds to purchase products in bulk
  • Vendors offering wholesale products
  • Payment and logistics partners facilitating transactions

Ujamaapay acts as a marketplace intermediary. We are not the manufacturer of listed products unless explicitly stated.

3. Eligibility

To use Ujamaapay, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Use the platform in compliance with applicable laws

We reserve the right to suspend accounts that violate these Terms.

4. Account Registration

You are responsible for:

  • Maintaining confidentiality of login credentials
  • All activities under your account
  • Ensuring your personal details remain accurate

You must notify us immediately of any unauthorized use.

5. How Collective Commerce Works

Ujamaapay enables users to pool funds for bulk purchases. Therefore:

  • Orders may only be processed once minimum group thresholds are met.
  • Delivery timelines may depend on group completion.
  • Prices may vary depending on volume achieved.
  • Cancellation rights may differ from standard single-item purchases.

By participating in group buying, you acknowledge and accept these mechanics.

6. Orders & Payments

6.1 Order Confirmation

An order is confirmed once:

  • Payment is successfully processed
  • Group threshold requirements are met (if applicable)

6.2 Pricing

Prices are displayed in Kenyan Shillings (KES). We reserve the right to:

  • Correct pricing errors
  • Cancel orders affected by system errors

6.3 Payment Methods

We may support:

  • Mobile money
  • Card payments
  • Bank transfers

We do not store full card details.

7. Delivery & Logistics

Delivery timelines are estimates and may vary due to:

  • Vendor processing times
  • Group purchase completion
  • Logistics partner delays
  • Force majeure events

Risk of loss transfers upon delivery confirmation.

8. Returns & Refunds

Refund eligibility depends on:

  • Product condition
  • Vendor policies
  • Nature of defect
  • Group purchase terms

Refunds may be processed:

  • Back to original payment method
  • As account credit

Certain items may be non-refundable.

9. Vendor Responsibilities

Vendors using Ujamaapay agree to:

  • Provide accurate product descriptions
  • Deliver goods as advertised
  • Comply with Kenyan laws
  • Avoid counterfeit or illegal products

Ujamaapay may suspend vendors who violate these standards.

10. Prohibited Activities

You may not:

  • Use the platform for unlawful purposes
  • Interfere with platform security
  • Engage in fraudulent activity
  • Manipulate group purchase thresholds
  • Upload harmful software

Violation may result in immediate suspension.

11. Intellectual Property

All content on the Platform, including:

  • Logos
  • Text
  • Graphics
  • Software

belongs to Ujamaapay or its licensors.

You may not reproduce or distribute content without permission.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Ujamaapay is not liable for indirect or consequential damages.
  • We are not responsible for vendor misconduct.
  • Our liability is limited to the value of the transaction in dispute.

Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.

13. Fraud Prevention

We reserve the right to:

  • Cancel suspicious transactions
  • Request identity verification
  • Suspend accounts suspected of fraud

14. Data Protection

Your personal data is handled in accordance with our Privacy Policy and the
Data Protection Act 2019.

15. Termination

We may suspend or terminate your account if:

  • You breach these Terms
  • We suspect fraudulent activity
  • Required by law

You may close your account at any time.

16. Changes to These Terms

Continued use of the Platform constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
